HB 597 – Capital Reappropriations Bill

House Bill (HB) 597 contains $2.09 billion in capital reappropriations for the biennium ending June 30, 2024 (FYs 2023 and 2024). The bill reauthorizes the unexpended balances from previously approved capital projects to ensure that those projects continue uninterrupted toward project completion. As Kimberly Murnieks, Director of Office of Budget and Management, explained in her testimony to the House Finance Committee, “the 'reappropriation' is necessary due to our constitutional provision that limits appropriations to two years. To reconcile this constitutional limitation with the reality that many capital projects require several years to complete, the reappropriation of the unspent balance of capital projects is necessary each biennium." HB 597 also provides clarifying language that priority for state funding for classroom facilities projects includes a subsequent segment of a project for which conditional approval has lapsed. Current law states only that first priority for project funding be given to a school district’s project in which approval has lapsed, but is silent on whether this includes districts with segmented projects. The bill clarifies that this priority for funding applies to districts with segmented projects.
