The state Tax Commissioner Jeff McClain last week issued final determinations on the petitions of Nexus Gas Transmission and Rover Pipeline to appeal their public utility tangible personal property (PUTPP) valuations. The Tax Commissioner’s ruling rejected both company’s petitions and affirmed the initial assessments of the PUTPTP valuations. Click here to read the rulings.
Nexus and Rover have 60 days from the date of the determination to appeal the rulings to the Ohio Board of Tax Appeals (BTA). If such an appeal is made, that process could take several months, and any decision of the BTA can be appealed to the Ohio Supreme Court.
Meanwhile, the pipeline companies could pursue a legislative change to address their valuation complaints. We will monitor the situation and keep members updated as we receive additional information.
