HB 169 – ESSER/GEER Appropriation and PPE Restrictions

House Bill (HB) 169, which served as a vehicle to disburse federal pandemic aid dollars to schools and other recipients, was signed into law in late December. Final bill analysis .

HB 169 included a provision that requires any personal protective equipment (PPE) purchased with the use of the bill’s appropriated funds, and any future appropriation of federal coronavirus funds, to be either:

  • Approved by the National Institute for Occupational Safety and Health; or

  • Authorized for use by the U.S. Food and Drug Administration, including under emergency use authorization.

 

The Ohio Department of Education (ODE) is aware of the provision and working with partner state agencies. Additional information will be shared as soon as it is received.
